2023 WM Phoenix Open

OVERVIEW: The WM Phoenix Open Million Dollar Sweepstakes (the “Sweepstakes”) comprises sixteen (16) separate drawings, one for each geographic region described in the Winner-Selection rule below.  Each drawing offers the opportunity for an eligible small-business customer to win a year’s free waste-removal service (max. value $18,000) plus the opportunity to be one of up to 20 finalists with a chance to win $1 million as described below.

ELIGIBILITY: The Sweepstakes is open only to small-businesses (under $1,500 per month average spend for waste removal over the past 12 months, excluding overages, extra pick-ups and other non-recurring charges) in the 48 contiguous United States or DC (excluding Montana), with (a) an active WM open market commercial contract and account as of September 5, 2022,  (b) an active WM Online Profile as of December 4, 2022, and (c) any of the following: (i) existing recycling services from WM as of September 5, 2022, (ii) added recycling services from WM during the Sweepstakes Period, or (iii) completion of the online entry form described in the “How to Enter” Rule below, including completion of the section explaining why your business doesn’t have or believe it needs recycling services. Affiliates or subsidiaries of Waste Management National Services, Inc. (“WM” or “Sponsor”), its advertising and promotion agencies, and suppliers are not eligible.   The Sweepstakes is subject to all applicable federal, state, and local laws and regulations. Void where prohibited by law.

AGREEMENT TO RULES:  By participating or accepting any prize, any eligible small business (“Entrant” or “you”) agrees to be fully unconditionally bound by these Official Rules, and to accept all decisions of the Sweepstakes judges, which are final and binding in all matters relating to the Sweepstakes.  

SWEEPSTAKES PERIOD: The Sweepstakes begins at 12:00:01 Central Time (“CT”) on September 6, 2022 and ends at 11:59:59 p.m. CT on December 4, 2022 (“Sweepstakes Period”). Sponsor’s database computer is the official timekeeping device for the Sweepstakes. 

HOW TO ENTER: During the Sweepstakes Period, visit https://www.wm.com/us/en/user/register to create or update your customer MyWM Online Profile with all required fields (creating and/or updating a WM Online Profile is free), and then complete your entry by visiting https://www.wm.com/us/en/inside-wm/phoenix-open/million-dollar-shot, clicking on the opt-in button, filling in all required fields and submitting the information; the field for providing a short explanation why your business doesn’t have or believe it needs recycling services is required only for businesses without such services. Limit one (1) entry per eligible small-business customer, regardless of method of entry. Any attempt to exceed this limit via multiple identities, email addresses, or other means is prohibited and grounds for disqualification. WM reserves the right to verify all facts concerning eligibility status for any small-business Entrant at any time, and each Entrant agrees to participate in any such verification process.  Failure to cooperate may result in disqualification.

On or about December 5, 2022, each potential winner in the drawings described above will be notified using the contact information for the primary contact person in the WM Online Profile of the Entrant selected as the potential winner.  WM shall have no liability for any potential winner’s failure to receive notices due to spam, junk e-mail or other security settings or for the potential winner’s provision of incorrect or otherwise non-functioning contact information.  If a potential winner cannot be contacted, is ineligible, fails to claim the prize within 30 days from the time award notification was sent, the prize may be forfeited and an alternate winner selected.   An authorized representative of each potential winner may be required to sign and return an affidavit of eligibility and a publicity and liability release, both for him/herself and the Entrant if it is a business entity separate from the individual person.   For avoidance of doubt, all prizes are awarded in the name of the person or entity listed as the customer in the Entrant’s WM Online Profile.   In the case of an Entrant that is a business entity, no prize will be awarded to any individual person without signed approval from an authorized representative of the business entity.   Failure to comply when requested may result in disqualification and selection of an alternate winner.     

PRIZES/ODDS:  

a.     Finalist Prizes: A maximum of twenty (20) finalist prizes are available, one (1) for the winner in each geographic-area drawing, and one for each of the five (5) winners in the at-large drawing, all as described above. Each finalist prize comprises the following: One (1) year of free service for the small-business open market commercial account in the Entrant’s WM Online Profile, max. value $18,000, plus the opportunity to participate in the Million Dollar Shot Event described below for a chance at a $1 million Grand Prize. The year of service will run from March/2023 to February/2024. Odds of becoming a finalist winner in any drawing depend on the number of eligible entries for that drawing.    

b.      Million Dollar Shot Event & Prizes: 

                        i. Each of the maximum of twenty (20) finalists will be assigned at random to one group of golfers scheduled to play in the third round of the Waste Management Phoenix Open, scheduled for Saturday, February 11, 2023 (“WMPO Third Round”). Assignments will be made the prior evening once the playing groups for the third round have been publicly announced. If more than twenty (20) groups will play in the WMPO Third Round, the finalists will be assigned to the final twenty (20) groups. If fewer than 20 groups play in the Third Round, assignment to the playing groups will be based on random draw among the finalists. All dates and times are subject to change based on weather conditions and other factors beyond Sponsor’s control. No guarantee is made that any group scheduled to play the WMPO Third Round in fact will play or will complete the entire round.

                       ii. If any player in the group to which a finalist is assigned scores an officially recognized hole-in-one on the 16^th hole during the WMPO Third Round, the finalist wins $1 million, payable $50,000 per year for 20 years (the “Grand Prize”). In the event an officially recognized hole-in-one is scored by two or more players in different groups to which finalists were assigned, the Grand Prize will be divided between/among such finalists. 

                      iii. If no player during the WMPO scores an officially recognized hole-in-one on the 16^th hole during the WMPO Third Round, no Grand Prize will be awarded, but instead WMPO Memorabilia, selected by WM (approx. retail value: $500), will be awarded to the finalist assigned to the group with the lowest total officially recognized score on the 16^th hole in the WMPO Third Round (i.e., the total score of all three players in the group). In the event of a tie for lowest score, the WMPO Memorabilia Prize will be awarded based on the tied group with the player whose tee shot was closest to the pin on the 16^th hole in the WMPO Third Round as determined by official PGA Shotlink information. Any group with fewer than three (3) players who complete the 16^th hole in the WMPO third round will not have its total score counted for purposes of this paragraph. If the $1 million prize is awarded based on a hole-in-one, there will be no WMPO Memorabilia Prize. 

c.     General Prize Conditions: No cash or other prize substitution shall be permitted except at Sponsor’s discretion. Sponsor may substitute a prize of comparable value if any advertised prize becomes unavailable. Prizes are non-transferable. Any and all prize-related expenses, and any applicable federal, state, and/or local taxes, shall be the sole responsibility of winner. Acceptance of prize constitutes permission for WM to use the name and likeness of the winner, and of each representative who participated in the Million Dollar Shot Event, for purposes of advertising and trade without further compensation, unless prohibited by law. Sponsor may conduct a background check to confirm any potential winner’s eligibility, as well as compliance with these Official Rules. You agree to cooperate reasonably with any such background check. Failure to cooperate may result in disqualification and selection of an alternate winner. If a potential winner has engaged in or does engage in any conduct that could damage the reputation or business of WM or its affiliated companies, as determined by Sponsor in its discretion, such person or potential winner may be disqualified. 

GENERAL TERMS: WM reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Sweepstakes in the event any virus, bug, non-authorized human intervention, fraud, or other cause beyond WM’s control corrupts or affects the administration, security, fairness, or proper conduct of the Sweepstakes, or if other circumstances beyond WM’s control – including but not limited to Acts of God, war, fire, riot, earthquake, terrorism, act of public enemies, actions of governmental authorities, pandemic or other causes – makes it impossible or impractical to conduct the Sweepstakes as contemplated. Without limitation, the Million Dollar Shot Event will not take place if the WMPO Third Round does not take place for any reason; in such circumstances, no prizes associated with the Million Dollar Event will be awarded. In the event of any other disruption or cancellation of any other aspect(s) of the Sweepstakes for any reason, WM may select the finalist winners from all eligible entries received that are unaffected by the problem in a fair and equitable manner as determined by WM. WM reserves the right, in its sole discretion, to disqualify any individual or Entrant who tampers or attempts to tamper with the entry process or the operation of the Sweepstakes or who violates these Official Rules. 

LIMITATION OF LIABILITY: By entering, You agree, to the extent allowed by applicable law, to release and hold harmless WM and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from: (i) Your participation in the Sweepstakes and/or your acceptance, possession, use, or misuse of any prize or any portion thereof; (ii) technical failures of any kind, including but not limited to the malfunction of any mobile device, computer, cable, network, hardware, or software, or other mechanical equipment; (iii) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Sweepstakes; (v) electronic or human error in the administration of the Sweepstakes or the processing of entries.

DISPUTES: This Sweepstakes is governed by laws of the State of Texas, USA, without regard to principles of conflicts of laws. Each entrant and every other person participating agrees, to the extent allowed by applicable law, that any and all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with the Sweepstakes, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Texas having jurisdiction. Further, in any such dispute, under no circumstances shall participant be permitted to obtain awards for, and hereby waives all rights to, punitive, incidental, or consequential damages, including reasonable attorney’s fees, other than participant’s actual out-of-pocket expenses (i.e. costs associated with entering this Sweepstakes).
